REFUND POLICY AND TERMS AND CONDITIONS
We realize that, sometimes, plans change. While some conferences operate under a strict “No Refunds” policy, we at Product Collective believe in helping keep things as flexible as possible, while also enabling us to run our events properly. The following represents our policy as it relates to Ticket Refunds and other Terms and Conditions.
1. INTRODUCTION
1.1 The Global edition of INDUSTRY: The Product Conference, the European edition of INDUSTRY: The Product Conference, INDUSTRY Virtual, INDUSTRY Virtual Workshops, and the New York Product Conference are all events (“events”) organized by Product Collective, LLC -- an Ohio-based limited liability company.
1.2 References to “us”, “we”, and “our” refers to Product Collective, LLC. References to “you” and “your” refer to the entity completing the purchase.
1.3. All registered attendees for the above events are subject to these Terms and Conditions.
2. TICKET REFUND POLICY
2.1 Refunds: Full refunds are available for any ticket purchased to any event only if the request is made no later than 45 days before the event date. Refund requests made after this period will not be honored. However, a ticket transfer as outlined in section 2.2 may apply.
2.2 Transfers: Tickets for all events can be transferred to another attendee without incurring any additional charge only if the request is made no later than 7 days before the event.
2.3 Fees: Any refund provided of any event will be for ticket fees collected by Product Collective, LLC and may not include processing fees charged by ticketing providers including, but not limited to, Eventbrite, Bizzabo, Universe, Hopin, or others used by Product Collective, LLC to service the ticketing of its various events.
3. USE OF LIKENESS IN MARKETING
3.1 Product Collective, LLC has the right to publicly announce your participation in INDUSTRY: The Product Conference, including but not limited to announcements on social media.
3.2 Product Collective, LLC may use any photography or video of all days where INDUSTRY: The Product Conference takes place, which may capture your image and likeness.
4. CHANGES TO THE CONFERENCE
14.1 It may be necessary for reasons beyond our control to alter the advertised content, timing and/or location of the conference or advertised speakers or cancel the event. We reserve the right to take these actions at any time.
4.2 Any request of cancellations due to changes in advertised content, timing, and/or location of the conference will be processed according to the Ticket Refund Policy described in Paragraph 2.
4.3 No refunds will be given in response to cancellations outside of the scope of our Ticket Refund Policy described in Paragraph 2.
4.4 Product Collective, LLC is not liable to you for fees, travel, accommodation, or other costs and expenses if we are required to cancel or modify the conference as a result of an event outside of our control. This includes, but is not limited to, acts of God, floods, lightning, storm, fire, military operations, war, acts of terrorism, or threats of such acts, any strike action, lock-outs, or widespread illness or force majeure.
5. CONTENT
5.1 All rights in all presentations, documentation and materials published or otherwise made available as part of the conference (including, but not limited to any presentations or audio or audio-visual recording of the conference) (“Content”) are owned by Product Collective, LLC or are included with the permission of the owner of the rights. You shall not distribute, reproduce, modify, store, transfer or in any other way use any of the Content for commercial reasons or in any way that might infringe third party rights or that may bring us or any of our affiliates into disrepute.
5.2 The Content does not necessarily reflect our views or opinions.
5.3. We take reasonable care to ensure that the Content created by us is accurate and complete, however, some of it is supplied by third parties and we are unable to check its accuracy or completeness. You should verify the accuracy of any information (whether supplied by us or third parties) before relying on it. The Content is provided on an “AS IS” basis without any warranties of any kind (express or implied). We hereby exclude to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content or arising from any infringing, defamatory, or otherwise unlawful material in the Content.
5.4 To the extent that any Content is made available by Product Collective, LLC on our website or any other online channels, we reserve the right to suspend or remove access to such Content at any time.
6. LIABILITY
6.1 Our aggregate liability to you, whether such liability arises in contract, tort (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind however arising, out of in connection with any booking (or requested booking) made by you or otherwise in relation to a conference or workshop, shall be limited to the price paid by you in respect of your booking to attend a conference or workshop.
6.2 We shall not be liable to you for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or; (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.
6.3 You agree to indemnify us, our staff and our affiliates and to hold us harmless to the fullest extent permitted by law, against all loss, costs, claims or expenses of any kind arising from any act or omission by you (including your attendees) during our otherwise in relation to a conference or workshop.
7. GENERAL
7.1 These Terms and Conditions contain the entire agreement and understanding between Product Collective, LLC and you and supersede all prior agreements, understandings, or arrangements (both oral and written) relating to the subject matter of these Terms and Conditions and any such document.
7.2 These Terms and Conditions do not create, nor shall they be interpreted as creating, any partnership or agency relationship between us.
7.3 You agree to the electronic means of communication and you acknowledge that all such communications that we provide to you electronically comply with any legal or contractual requirement that such communication be made in writing.
7.4 These Terms and Conditions and the rights and obligations of both parties shall be governed by, and construed in accordance with, the laws of the State of Ohio.
7.5 We reserve the right to refuse entry at our sole discretion.
8. CODE OF CONDUCT
8.1 INDUSTRY: The Product Conference operates under a state of beliefs, which we adopt as our code of conduct, which may be found here.
